The European Commission adopted the Commission Implementation Decision (EU) 2021/867 on the harmonized standards of toys. The decision was drafted to support the update of the harmonized standards of Directive 2009/48/EC, mainly involving EN 71-7, EN 71-12 With the current edition of EN IEC 62115, all other standards cited remain unchanged. This decision will take effect immediately from the date of publication in the EU Gazette on May 31, 2021. Implementation decision (EU) 2019/1728 was annulled.
This time, the three harmonized standards updated by the Toy Safety Directive 2009/48/EC are as follows (from May 31, 2021)
Toy safety-Part 7: Finger paints-Requirements and test methods
EN 71-7:2014+A2:2018 will be replaced by EN 71-7:2014+A3:2020. The basic adjustment is to lower the limit of the preservative Climbazole in the standard. Previously, this requirement has been implemented through the restrictions in the previous version of OJEU. Other than that, only minor corrections were made.
These changes do not need to be retested or evaluated because the adjustment requirements for Climbazole have been met.
Toy safety-Part 12: N-nitrosamines and N-nitroso compounds
The European Commission finally decided to replace EN 71-12:2013 with EN 71-12:2016.
EN 71-12:2016 represents the current state of the art in analysis, because the limit of quantification (LOQ) of N-nitrosamines can be significantly reduced, and the adjustment of elastomer testing procedures (sampling and migration) leads to a more uniform application of test methods.
Nevertheless, EN 71-12:2016 introduces lower limits for certain product types, which exceed the requirements specified in the current version of the Toy Safety Directive 2009/48/EC. Since the limit set in the Directive 2009/48/EC is the limit to be complied with, it is necessary to add an informative note on the publication of the standard EN 71-12:2016. In the summary list, "restrictions" have been added, the controversial part of EN 71-12:2016 has been excluded, and the restrictions of the directive have been issued.
